PURCHASE AGREEMENT
SALE CONDITIONS AND TERMS OF SUPPLY
Definitions
In this term and conditions:
“The company” means HK International Ltd and all of its divisions and subsidiary companies.
“The customer” means any person, firm, company or other legal entity which places an order, or buys any products from the Company and includes the employees, agents or sub-contractors of any such person, firm, company or other legal entity.
“Food” means any food or beverage.
“Equipment” means any machine or equipment.
“Non-Food” means any goods, which are not food or equipment.
“Contract” means a contract between the Company and the Customer for the sale and purchase of the Products.
“Products” means any Food and/or Equipment and/or Non-Food agreed in the contract to be supplied by the Company to the Customer.
“Statutory Interest” means statutory interest as defined in Late Payment of Commercial Debts (Interest) Act 1998.
General
All dealings are subject to the following conditions of sales in which HK International Ltd is referred to as “the Company”.
The user who accesses the site, views the pages and interacts with it, accepts the following conditions and also that any questions or disputes arising out of the application of the UK law will be applied exclusively.
Distinctive signs (logos, trademarks, mottoes, texts, etc.) contained within the site are the sole property of the company and are therefore forbidden for reproduction and use outside the site.
All contents of the site (such as images, texts, descriptions, etc.) are the property of the firm and are protected by UK law.
No part of this site may be copied in whole or in part or modified or incorporated into any other work or site and the firm reserves the right to pursue both legal and civil litigation actions against those who violate such prohibition.
These Terms and Conditions shall be incorporated into the Contract and shall apply in place of a prevail over any terms and conditions contained or referred to in any communication from the Customer or implied by the custom or practice.
The Company reserves the right to amend or update the current Terms and Conditions.
Prices, Payment, Availability, deliveries
Prices quoted by the Company are current from January 2021. The Company reserves the right to change prices without notice. Prices charged will be those ruling at date of despatch.
Prices, codes and availability of products are indicated on each product sheet and may be subject to change without prior notice. The Company reserves the right to change prices without notice.
The availability of the products displayed on the site varies from article to article and is visible within each product card.
In case of unavailability of an item ordered, takeawayworld.com will always contact the customer before ordering the order to inform you about it and therefore determine whether to proceed without the item unavailable or cancel the order.
The images have the sole purpose of illustrating the products and in some cases they may not faithfully respect the actual features of the products.
Payment terms are strictly 28 days net. (This terms only apply to wholesalers and bulk buyers under separate T&C) If payment is not made by the due date the Company may charge interest at the rate of 4% per annum above the base lending rate of National Westminster Bank PLC from the due date of payment until the actual date of payment.
New accounts will be asked to pay pro–forma prior to a credit account being opened.
Minimum order values differ for various geographical areas and these values are available to the Customers upon application. The Company reserves the right not to deliver an order which is valued less than the latest published minimum order values.
Customer Registration and Customer Access Mode:
You can buy the products only through the website www.takeawayworld.com. It is not possible to purchase by telephone or email.
The buyer will receive the email address provided during the registration of the registration confirmation where the relevant link will be clicked to activate his account and thus be able to access the site area of the site with his / her credentials (user name and password).

The customer, both in the registration process and in the subsequent ones, undertakes to provide truthful and non-fraudulent information.

It is not possible to register on the site by providing third party data to them without knowing it, except in the case of registrations made in the name and on behalf of legal entities by the legal representative or authorized person.
Registration at www.takeawayworld.com is considered to be completed by the time the customer clicks on the link in the message sent to the registration email, verifies his / her email address and thus activates his account on the www.takeawayworld.com.
Only after such verification will the customer access his account created on www.takeawayworld.com with his / her login credentials (email address and password).
The customer is responsible for their access credentials and undertakes not to provide it to third parties or to divulge them in any way.
Customer is required to verify, supplement, and maintain your account information updated.

Unless confirmed in writing the Company will not be responsible for any mistakes made in entering and processing verbal orders.
DELIVERY INFORMATION
Currently, we can only send your order to the UK mainland addresses.
We DO NOT send any Order to Scotland highland, Channel Islands and the Isle of Man.
Delivery times are variable due to the region and delivery Courier Company and may it takes about 3-5 working days.
Rest of the World (Delivery to be advised).
Received orders will be delivered in 3-5 working days. If we have insufficient stock levels to meet your request and cannot meet this obligation you will be contacted and advised when your order will be delivered.
For deliveries to third parties, the Company will accept no liability for shortage or non-delivery unless given in advance the name of a specified person who will sign for the goods. Any non-delivery must be notified to the Company within 2 days and confirmed in writing to enable a claim to be made against the carrier.
On delivery, the customer should count and check the cartons carefully and the carrier’s notes signed accordingly. A “clean” signature prevents any claim against the carrier and may result in any claim being rejected by the Company.
Any shortage or damage must be notified immediately and confirmed in writing within 2 days.
Deliveries of Products to the Customer shall be in accordance with the Company’s delivery schedule.
The Company will not always guarantee delivery in accordance to the Customer’s requested timing schedule.
The company shall not be liable for any loss or damage whatsoever arising as a result of failure to deliver Products by a particular date or arising as a result of any causes beyond the Company’s control.
The delivery of the Products shall be made by the Company to such reasonably accessible premises as the Customer shall require. The Customer shall be present at the premises to take and sign off the delivery of the Products.
Deliveries will be made to the address specified by the Customer when the account was opened or updated.
The company reserves the right to restrict deliveries in certain areas, and this includes the right to eliminate certain areas from the Company’s delivery schedule altogether.
If the Customer fails to take delivery or fails to give the Company adequate delivery instructions at the time stated for delivery then without prejudice to any other right or remedy available to the Company, the Company may do one or more of the following:
Charge the Customer the cost of carriage of the refused delivery both to and from the premises specified by the Customer in addition to the Company’s administrations and re-stocking charges, which are available upon application.
Charge full cost price for perishable Products.
Charge the Customer a re-scheduling delivery charge.
Additional Services and Delivery Methods
It is not possible to request additional services such as appointment service or delivery notice, and any requests in the annotations will therefore not be considered.
The ordered goods are delivered by the courier at the level of the road plan (it is not possible to request the delivery to the plan).
The Customer undertakes to provide complete, accurate and truthful information about the delivery address and to cooperate with the courier and / or with takeawayworld.com in order to facilitate the delivery of the ordered goods.
In particular, in the event of difficulties for delivery by the courier or goods in stock for any reason irretrievable or unavailable to the recipient, the Customer is required to promptly inform takeawayworld.com and cooperate with the courier and its drivers to resolve the problem.
Any costs of stock, delivery, return to our warehouse, etc., are the responsibility of the Customer.
In the case of non-withdrawal, irrevocability or refusal to receive the ordered goods, takeawayworld.com will no longer accept any further orders from the Customer and will recover the expenses incurred as well as providing the complaint to the court for fraud cases or other criminal and civil malpractices arising from the behaviour of the Customer or third parties.
Damage during Shipment and Reserve in Bubble
The goods are at the Customer’s risk and therefore, at the time of delivery by the courier, they are obliged to accept the goods by filling in the delivery note (or other delivery proof of the courier) with the words “I agree with the Verify “as provided by law.
If Customer does not do so, we will not be in a position to be able to assist you in the event of shipping problems (damages, breaks, partial or total bills, etc.)
If the goods are damaged, if you have followed the above procedure, simply contact us to find the solution (replacement or refund of the goods at the customer’s choice).
Descriptive Matter
Photographs, drawings and other descriptive material are for the purpose of description only and shall not form part of the contract.
While the Company will at all times endeavour to notify customers of any changes to the product range or pricing they nevertheless shall be entitled, without prior notification, to alter any of the dimensions and/or specifications of, or to modify or discontinue any of their products or to revise any or all of their prices.

Reservation of Title
The goods sold under these conditions shall remain the property of the Company and legal title shall remain vested in the Company until payment in full of all amounts invoiced or due to the Company in respect of the goods, or until the goods are resold by the customer, whichever shall first occur.

By submitting personal information you consent to the use of that information as set out below: We may use your IP address or other identifying information to help diagnose problems with our server, to monitor numbers of users and/or to administer our interactive services.
